Terms and conditions

1. General

1.1 This website is owned by Aesthetic Supplier (referred to in this document as “we”, “us”,”our”,”Aesthetic Supplier”).

1.2 Upon completing a purchase you will be registered with us as a business customer and the ensuing Terms and Conditions will govern any transactions.

1.3 When purchasing any products or devices via telephone, email, messages or this website you acknowledge that you have read and you agree to comply with these Terms and Conditions and Privacy Policy.

1.4 Aesthetic Supplier reserves the right to modify any aspect of the Terms and Conditions and Privacy Policy at any time.

1.5 Product(s) Definitions

1.5a Devices – All equipment bought through this website, email, telephone, or messenger. Regardless of the purchase method, the regulations outlined below for device purchases are applicable. Aesthetic Supplier does not maintain stock for any Devices in our offering. All Devices are customized, and delivery times and guarantees may vary based on the Device’s make and model. Please consult the specific product page for Device(s) descriptions. 1.5b Products – All items listed on this website, excluding Devices and Courses. Products are subject to the additional terms and conditions regarding delivery, returns, and exchanges outlined below.

2. Device(s)

2.1 Purchase of Device(s)

2.1.1 Displaying Device(s) on our website, presenting them via telephone, email, or any messenger constitutes an invitation to entertain offers for said Device(s) and does not signify a binding offer for sale at the listed price. We retain the right to decline any order, even if confirmed and the credit card has been charged.

2.1.2 Upon placing an order on our website, we will promptly acknowledge it by email. For orders placed over the telephone or email, an invoice will be provided within 5 days. All Device(s) are custom-made based on customer preferences, and our production relies on the manufacturing capacity of the supplier.

2.1.3 The fulfillment of any order, whether accepted or not, is contingent upon the manufacturer’s capacity for the specified Device(s). If any issues arise affecting your order, we reserve the right to notify you within 14 calendar days from the order date. Together, we will seek a resolution, such as order cancellation or an alternative Device(s). If the price of the alternative Device(s) differs from the originally ordered Device(s), we will adjust the payment accordingly.

2.1.4 The moment of purchase is considered when payment or partial payment is made through various available options, such as credit or debit card, Paypal, Klarna, Instalment, Leasing, etc., irrespective of whether it constitutes a full payment or a partial deposit. In the case of a deposit, full payment must be completed before the Device(s) is dispatched to the provided address. Failure to make full payment will result in redirecting the Device to our Sheffield location, initiating the procedure outlined in point 2.2.5.

2.2 Delivery of Device(s)

2.2.1 Orders accepted for any type of Device(s) before 5:00 pm on a working day will be processed that day. We will make reasonable efforts to meet the specified delivery request below, provided no additional security checks are necessary, and the required sub-components for building the Device(s) are available. (A working day refers to any day other than weekends and public holidays.) After placing an order and completing full payment, your Device(s) will be delivered within 1 to 6 weeks, depending on the brand and model of the Device.

2.2.2 The risk associated with the condition of Device(s) and the delivery itself transfers to you upon the Device(s) being signed as delivered at the specified delivery address during the order. Alternatively, if the customer is not present at this address during delivery, the risk is transferred at any other provided delivery address or when the Device(s) has been delivered to our business premises after a delivery failure at the addresses provided by the customer.

In the event that redelivery is necessary from Aesthetic Supplier premises, the customer is responsible for arranging the redelivery, covering all associated costs, and being fully accountable for any potential damage, visible or invisible, resulting from the new shipment. The customer must ensure that the Device(s) is delivered without any visible damage, as we accept no responsibility for damage or loss after the risk has transferred.

2.2.3 Upon receiving your order, you will be required to sign for the goods/Device(s) received in good condition. If the package appears to be in poor condition, take photos of the external packaging and unpack the Device(s) in front of the driver to ensure that any damages are witnessed under the external packaging. Take multiple photos at different stages of opening the external packaging. If the Device(s) is damaged, refuse the delivery and notify us

immediately. Also, request a document signed by the driver confirming the visible external and internal damage to the delivered Device(s). This is necessary for any future claims against damages during transport. Failure to do so may impact any subsequent warranty claims and may result in claim denial. If you are unable to check the contents at the point of delivery, sign for the delivery as “UNCHECKED,” but only if there is no visible damage to the external packaging. We will require photos as proof of undamaged external packaging for claims related to transportation damage, which has been signed as unchecked. Ensure that photos of the packaging are taken upon accepting delivery, as failure to do so may affect warranty claims and result in claim denial.

2.2.4 We will promptly inform you if we are unable to deliver the Device(s) on the specified date, and you may agree to an alternative delivery period and provide a new delivery address if the revised date affects your schedule. In no event shall we be liable for any financial losses due to a delay in delivery, and the timing of delivery is not considered essential to the contract and is dependent on various factors beyond our control.

2.2.5 If you fail to take delivery of the Device(s), and without prejudice to any other rights and remedies available to us, we may:

– Store the Device(s) until a new delivery is arranged by the customer under the terms described in point 2.2.2 within a period not exceeding 14 calendar days. After this period, a storage charge of £10 per day per Device will apply, and the total outstanding amount must be cleared before the Device(s) can be collected, with the collection period not exceeding 45 calendar days. If the storage of the Device(s) exceeds 45 calendar days, we reserve the right to:

– Sell the Device(s) at the best readily obtainable price, deducting all reasonable storage and selling expenses, and accounting to you for any proceeds received.

We reserve the right for a one-month period to make every effort to resell the Device(s) before settling with the original customer under the terms described above.

– If we are unable to sell the Device(s) during the one-month period, the maximum refund we can offer is 50% of the Device(s) value, minus expenses paid by Aesthetic Supplier, such as customs clearance and delivery, as explained in point 2.3.2.

2.3 Maintenance of the Device(s)

2.3.1 All Devices accessible at www.aestheticsupplier.co.uk require proper upkeep to ensure their optimal performance. Maintenance procedures vary based on the brand and model of each Device, with common practices including regular replacement of filters and needles. For instance, Devices with water circulation, necessitate monthly clearing of the circulation system.

Comprehensive guidelines on how to maintain your Device(s) can be found in the Maintenance instructions sent to customers after the purchase of a Device. Aesthetic Supplier endeavors to ensure the transmission of this information to customers. However, it remains the customer’s responsibility to confirm receipt of and understand the Maintenance

instructions. If uncertainty arises regarding whether your Device requires maintenance, please consult a member of our team for guidance.

2.3.2 Customers bear the responsibility of adhering to regular maintenance practices outlined in the manufacturer’s guide or our recommendations. Failure to conduct regular maintenance or improper maintenance methods may impact the lifespan of your Device(s) and potentially void the warranty. It is crucial to diligently take necessary measures to keep your Device(s) in optimal condition.

2.3.3 Aesthetic Supplier strives to furnish all necessary maintenance instructions; however, it is not our obligation to proactively provide this information to customers. Maintenance instructions are available upon request. Prior to making a purchase, consult with our team to ascertain best practices and understand the essential actions required for caring for the purchased Device(s). Customers are accountable for ensuring they comprehend the proper care and regular maintenance protocols for each Device they own.

2.4 Warranty of the Device(s)

All other Devices available on our website carry a fixed warranty period of 12 months.

2.4a In the event of a faulty Device, our initial effort is to address the issue over the phone whenever possible. If the fault cannot be resolved through remote assistance, the Device needs to be sent at the customer’s expense to the UK Service Point for inspection. To initiate this process, you will be required to email a copy of the warranty card and seven clear photos (one from each side of the device, one from the top, one showing secure packaging for transportation, and one showing the package ready for shipment). We recommend using Royal Mail next day by 1 pm service with insurance covering the value of your device, as this shipment is at the customer’s risk. If the UK Service Point confirms that the Device became faulty due to reasons not related to incorrect usage (not following the manufacturer’s guide or our advice), unauthorized repairs, damages from water or any other liquid, mechanical damage, or electrical shorts in the network, we will replace the Device free of charge. If the test results indicate that the customer used the Device not in line with the manufacturer’s guide or for any of the above reasons, we will refuse replacement, and the customer will be required to collect or arrange collection on their behalf, at their own expense and risk from the UK Service Point. For approved replacements, please allow a period of up to 4 weeks due to stock availability at the time of the request.

2.4b Aesthetic Supplier does not provide temporary replacement Devices during repair periods.

2.4c Please retain the original packaging for your Device(s), as it is required in case of repairs to ensure safe transportation. If the Device(s) is sent without the original packaging,

the risk and responsibility for safe transportation are transferred to the customer, and any potential claims related to damage during transportation may be refused.

2.4d Aesthetic Supplier utilizes all available resources to ensure that your Device(s) will be repaired or replaced at the earliest possible time. However, we do not take responsibility for any loss of income or bookings resulting from faulty Device(s) or the duration of repairs.

2.4.2 Device(s) fault occurs outside of warranty period

2.4.2.1a In the event of a fault occurring outside the warranty period, we offer the following options:

2.4.2.1b We can act on your behalf by contacting the manufacturer and the UK Service Point to obtain a quotation for necessary repair work, as per your request. You will be responsible for all associated charges, including collection and delivery back to the customer, sub-components required for Device repair, engineer working time, etc. These expenses must be settled before the repairs are carried out. Your Device(s) may need to be physically present at the UK Service Point for necessary tests to determine the required works before the cost of repair is provided to you. In such a case, you will be required to deliver the Device(s) to the UK Service Point at your expense and risk. If, for any reason, after receiving the specified repair costs, you decide not to proceed with the repair, you are still responsible for collecting the Device(s) at your own cost and risk. The service duration is estimated to be between 1 to 6 weeks, depending on the type of fault, the availability of engineers, and the resources available for repairing your Device(s). Initially, we strive to arrange repairs at the UK Service Point; however, if the UK Service Point is unable to repair your Device, it may be necessary to send it back to the manufacturer, incurring additional costs for customs clearance, which are payable by the customer.

2.4.2.1b Alternatively, we can provide you with the direct details of the UK Service Point, allowing you to arrange any necessary repairs or service independently.

2.4.2.2 Customers have the option to engage their own service company for required repairs. This may involve telephone consultations with the UK Service Point or, when necessary, the delivery of the Device(s) to the UK Service Point to diagnose the problem (service fees may apply based on the UK Service Point price list) and order required parts.

2.4.2.3 All charges incurred in this process are paid directly to the UK Service Point, and Aesthetic Supplier is not involved in this transaction at any point.

2.4.2.4 Aesthetic Supplier does not assume any responsibility, including financial responsibility, for any work carried out by the UK Service Point after a fault occurs outside of the warranty period. Any claims must be directed to the UK Service Point.

2.4.3 Device(s) warranty exclusion

2.4.3a The warranties specified in clauses 2.4.1 to 2.4.5 do not extend to defects in the Device(s) arising from negligence, damage caused by the user, accidents, use other than in accordance with its intended purpose, failure to adhere to manufacturers’ or our instructions, or any alteration or repair carried out without our written approval.

2.4.3b The terms and conditions of the manufacturer’s guarantee operate independently of the provisions of the Consumer Rights Act of 30 May 2014 and are subject to the legal provisions outlined in articles 5771 of the Civil Code.

2.4.3c The manufacturer’s warranty expires in the following instances: – Use of the equipment contrary to the requirements of the operating instructions. – Damage to the equipment resulting from intentional or erroneous actions by the Consumer. – Presence of mechanical or other damage to the equipment.

– Penetration of liquids, dust, insects, or other foreign bodies into the equipment. – Independent disassembly or other external interference with the structure of the equipment.

2.4.3d The manufacturer’s warranty does not cover equipment failures caused by the following:

– Damage to parts and fast-wearing components, as well as consumables (batteries, Velcro cuffs, gloves, fabric accessories, etc.), resulting from improper or careless installation, use, storage, or maintenance.

– The use of poor-quality, homemade, or worn-out components.

– Force majeure events (accidents, fire, flood, power failure, etc.).

2.5 If you cancel your Device(s) order

2.5.1 If payment has been processed for the Device(s) and you decide to cancel the order within the initial 72 hours from placing the order, we will issue a full refund within 7-10 days upon receiving your cancellation notification. Should you opt for an alternative Device(s), these Terms will remain applicable. In the event that payment has been processed for the canceled order within the specified time frame, we will refund any overpayment or collect payment for any underpayment.

Please note that all Devices are custom-made, and if you cancel your order after 72 hours but before 7 calendar days from placing the order, a restocking fee, including an administrative charge of 10% of the total purchase price, will be applied. It’s important to understand that Aesthetic Supplier initiates the production order on the same day as receiving payment from the customer, and production starts on day number 4. Free cancellation is not applicable beyond this point, and different cancellation fees apply based on the production and transportation stages, as described in this section.

2.5.2 After 7 calendar days, when the production order for Device(s) has been placed with the manufacturer, and production has commenced, or the Device(s) has been delivered or prepared for dispatch or taken by the transport company for delivery, the settlement method is as follows:

2.5.2.1 The refund amount includes a deduction of 25% of the value of the Device(s) made to the customer’s order, along with costs incurred or to be incurred by our company for collecting Device(s) from the manufacturer when the production process has already started. This includes customs clearance (75GBP for each invoice or order) and delivery fees, which vary depending on the type of Device(s).

2.5.3 Prices of Device(s) on our website include customs clearance and delivery fees. However, in case of order cancellation after the production order has been placed or production has started, or the Device(s) has been delivered or prepared for dispatch or imported into the UK territory, Aesthetic Supplier reserves the right to pass on to the customer the expenses incurred due to late cancellation, affecting the final refund amount. If the Device(s) has already been delivered to the customer, a refund will be processed only after all Devices and sub-components are returned to our company premises at the customer’s expense and risk. Cancellation of Devices will be inspected to confirm they are brand new, unused, and free from visible and invisible damage that may affect the functionality, likely caused during transportation between the customer and Aesthetic Supplier premises.

2.5.3.1 Customers have 14 calendar days from the date of delivery to deliver Device(s) to Aesthetic Supplier premises. Device(s) delivered after this period will be refused and returned to the customer at their expense.

2.5.4 We reserve the right for 14 calendar days from the time of receiving returned Device(s) to conduct all necessary inspections. If the Devices are unused and in new condition, containing all original, undamaged packaging, we will process a refund within 7-10 calendar days from the date of completing the inspection, based on the calculations explained in section 2.5.

Note

We can only accept Device(s) for a refund if they have never been used and do not exhibit visible or invisible signs of damage or faults, as described above. If used Devices are sent to us for a refund or if the Device arrives damaged or faulty, we reserve the right to refuse a refund. The Device(s) will be held for customer collection at their expense and risk. In such cases, we can store the Device(s) for a maximum of 14 calendar days, free of charge, up to a total of 45 calendar days before disposal. A storage fee of 10GBP per Device per day applies between the free period of 14 calendar days and the maximum storage period of 45 calendar days. Device(s) can be collected from Aesthetic Supplier premises before 45 calendar days after settling the arrears resulting from the storage of Device(s).

3. Purchase of Products

3.1 The inclusion of a Product on our Website is an invitation to entertain offers for such a Product and does not constitute an offer to sell at the listed price, nor is it binding on us. We

retain the discretion to decline your order, irrespective of whether the order has been confirmed or the credit card has been charged.

3.2 Upon placing your order for a Product, we will send an acknowledgment via email. Subsequently, within 5 days of this email, we will inform you if we have accepted your order, providing expected delivery dates simultaneously.

3.3 Every order, whether accepted or not, is contingent on the product’s availability. If, prior to delivery, the product becomes unavailable, we will notify you within 14 days of order acceptance. At that point, you have the option to:

3.3a Cancel the order and receive a full refund.

3.3b Opt for an alternative product.

In case of order cancellation, where payment has been processed for the product, we will issue a refund within 7-10 days upon receiving notification of the cancellation. If you choose to purchase an Alternative Product, these Terms will be applicable. For cancelled orders, we will refund any overpayment or collect payment for any underpayment. Please note that all products are made to order, and the restocking fee is 8% of the total purchase price, excluding delivery charges. Standard factory returns incur a cost of £250 via courier.

3.4 In the event a Product is incorrectly priced due to an error, we will notify you within 14 days of order acceptance of the correct price via email. You will then have the option to either purchase the Product at the corrected price or cancel your order. If you confirm your intention to purchase at the corrected price, we will proceed with delivering the product according to the original agreement. In case of order cancellation, where payment has been processed and the product has been sent out, we will issue a refund within 7-10 days upon the return of the product. If the product has not been dispatched, a notice of cancellation will be issued.

4. Delivery

4.1 Orders accepted by us before 5:00 pm on a working day will be processed on that day, and we will make reasonable efforts to meet the specified delivery as indicated on the Website, provided no additional security checks are necessary, and the requested Product is available. (A working day is defined as any day excluding weekends and bank or public holidays.) After placing and fully paying for your Products, delivery will take place within 1 to 6 weeks, depending on the specific product.

4.2 The risk associated with the Products transfers to you upon the Products being signed for at the specified delivery address provided during the order. We do not assume responsibility for any damage or loss to the Products after this transfer of risk.

4.3 Upon receiving your order, you will be requested to sign for the goods, confirming their receipt in good condition. If the packaging appears to be in unsatisfactory condition, please refuse the delivery. If you cannot inspect the contents of your delivery at the time of receipt,

sign for the parcel as “UNCHECKED.” Failure to do so may impact any warranty claims made subsequently.

4.4 If, after acceptance, we are unable to deliver the Products to you on the specified date, we will promptly inform you, and you may either agree to an alternative delivery period or choose to cancel the order. We shall not be liable for any financial losses resulting from a delay in delivery, and the timing of delivery is not considered essential to the contract.

4.5 In the event of your failure to accept delivery of the Products, and without prejudicing any other rights and remedies available to us, we may:

– Store the Products until actual delivery and charge you reasonable costs, including storage and postage.

– Sell the Products at the best readily obtainable price and account to you for any proceeds received after deducting all reasonable storage and selling expenses.

5. Cancel policy

5.1 You retain the right to cancel the contract if your Product is faulty (personalized devices cannot be returned unless faulty) within 5 working days after receiving the Products. To exercise this right, notify us via email to the provided email address. A restocking fee of 8% and incurred delivery costs will apply.

5.2 If you decide to cancel the contract after the Products have been delivered, you must return them to the address specified in the ‘Returns’ section of the client area on our Website at your own cost and risk. If the cancellation occurs before the Products are delivered and they are received afterward, do not unpack them; instead, promptly return them to us. In either case, the Products must be returned within 5 working days of notifying us of the cancellation under 5.3 or, if later, upon receiving them. The customer is responsible for shipping costs, and a cancellation/restocking fee of 8% of the total purchase price (excluding delivery charges) is applicable.

5.3 If the Products are not returned within the specified period, we reserve the right to charge you a sum not exceeding the direct costs of recovering the Products.

5.4 Until the Products are returned, you must keep them in your possession and take reasonable steps to prevent any damage. Upon receiving the Products in the same condition they were delivered to you, we will refund you for the Products within 7 to 10 days of their receipt by us.

5.5 Items not required – A contract for consumable goods, which, by their nature, cannot be returned, cannot be canceled unless a fault is discovered that could not have been identified without unsealing the goods.

6. Product

6.1 The Products are under your responsibility from the moment of delivery. Aesthetic Supplier cannot be held liable for any misuse or mishandling of the product.

6.2 Ownership of the Products will not transfer to you until we have received full payment (in cash or cleared funds) for:

– the Products; and

– all other sums owed to us.

6.3 We have the right to seek payment for the Products even if ownership has not yet passed.

6.4 Until ownership of the Products is transferred to you, you must:

– store the Products separately (at no expense to us) from all your other products and those of any third party, ensuring they remain easily identifiable as our property; – refrain from destroying, defacing, or obscuring any identifying mark or packaging on or related to the Products;

– maintain the Products in satisfactory condition and insure them on our behalf for their full price against all risks.

7. Warranty

7.1 All products are backed by a 6, 12, 18, or 24-month guarantee (depending on the product brand), as outlined in the respective product specifications on the website. Should a fault arise, Aesthetic Supplier commits to offering repair or replacement within the specified guarantee period. In the event of a fault occurring beyond this period, we can liaise with the manufacturer on your behalf to obtain a repair quotation. You will be responsible for all associated postage charges. If a repair is unattainable, a refund will be proposed, and the service duration typically ranges from 3 to 6 weeks.

7.2 The warranties specified in clause 6.1 do not cover defects in the products resulting from negligence, damage caused by you, accidents, use contrary to intended purposes, failure to adhere to manufacturers’ or our instructions, or any alterations or repairs conducted without our written approval.

7.3 Delivery of all products will be handled by a member of the Aesthetic Supplier team or UPS. Products must be inspected on-site and returned on the same day if any faults are identified. In cases where a third party makes the delivery, any damage, incompleteness, or discrepancies from your order must be reported to us via email immediately, and in any case, within 48 hours of delivery. We will organize the collection of the products for return within 5 days of receiving such notification, following our online returns procedure.

7.4 Please be aware that any products returned under a claim of being defective will undergo verification by our technicians. If the returned products are found not to be defective, they will be returned to you, and we will charge you for the return transport costs via your original payment method or withhold the product until we receive full payment for the return transport costs.

7.5 Any products you return are at your own risk; therefore, we strongly advise taking reasonable care when returning products by ensuring they are correctly addressed, adequately packed, and shipped by a reputable carrier.

7.6 In the case of exchanging products, any additional payments required will be deducted using the same payment method as the original purchase. Replacement products will not be dispatched until this payment is received.

7.7 Guarantee obligations:

All cosmetic equipment models manufactured by Alvi Prague are covered by an 18-month guarantee and a 6-month guarantee for heads.

For guarantee repairs, the consumer is responsible for delivering the cosmetic equipment to our service center and covering the return expenses after repair.

For non-warranty repairs, both the delivery to our service center and the return of the equipment to the buyer after repair are at the consumer’s expense.

In the post-warranty period (after the 18-month manufacturer’s warranty expires), the delivery to our service center for cosmetic equipment repair and the return of the equipment after repair to the buyer occur at the consumer’s expense.

The manufacturer’s guarantee conditions align with the provisions of the Consumer Rights Act of May 30, 2014, under the law’s articles 5771 of the Civil Code.

The manufacturer’s warranty ceases in cases of:

– equipment use contrary to operating instructions;

– damage due to intentional or erroneous actions by the consumer;

– mechanical or other damage to the equipment;

– the entry of liquids, dust, insects, or other foreign bodies into the equipment; – independent disassembly or external interference with the equipment’s structure. The manufacturer’s warranty excludes equipment failures caused by:

– damage to parts and fast-wearing components, as well as consumables (batteries, Velcro cuffs, gloves, fabric accessories, etc.) resulting from improper or careless installation, use, storage, or maintenance;

– the use of poor-quality, homemade, or worn-out components;

– force majeure (accident, fire, flood, power failure, etc.).

8. Prices and Payment

8.1 The prices for the Products and delivery are available on enquiry. Consumables have their prices displayed on our Website and will incur a postage charge. 8.2 If you agree to purchase you must pay for any Products ordered by you within 10 days of date of invoice. Time for payment is of the essence. If you do not pay on time we may

(without prejudice to our other rights and remedies) cancel the order and return any money paid in way of deposit.

8.3 If you fail to pay us any sum due pursuant to the contract, you shall be liable to pay interest to us on such sum from the due date for payment interest at the rate set out under the Late Payment of Commercial Debts (Interest) Act 1998

8.4 Payments may also be made by credit or debit card, by BACS transfer and we shall not dispatch any Products until we receive cleared funds.

9.5 We shall not be liable for:

– Loss of profit,

– Loss of business, or

– Any consequential or indirect loss, except for:

– Fraud, or

– Any liability under the Consumer Protection Act 1987.

9.6 Consequential Loss: We do not accept responsibility for any loss of earnings or other consequential losses incurred by you resulting from product failure or delivery delays.

9.7 Except for warranties expressly set out in these terms and conditions, all implied warranties, conditions, or representations, whether implied by statute or otherwise, are excluded to the fullest extent permitted by law.
